Terms of service

A short agreement between you and us.

These terms cover your use of ThoughtSpasm — the mobile app, our backend services, and anything else we make accessible to you. By pairing your messaging account or creating a ThoughtSpasm account, you agree to what's below. We've kept it short and tried to keep legalese to a minimum.

The agreement

In short
By using ThoughtSpasm you accept these terms. If you're using it for an organisation, you're confirming you're authorised to do so.

These terms form a binding agreement between you and the operator of ThoughtSpasm. If you're using ThoughtSpasm on behalf of an organisation (a company, partnership, or other entity), you're confirming that you have authority to bind that organisation, and "you" in these terms means both you and the organisation.

Your account

In short
One account per person. Keep your pairing token safe. Tell us if it's compromised.

You may hold one ThoughtSpasm account per person. Pairing your messaging account is what authenticates you — keep your phone and your messaging account secure, as anyone with access to them can send messages that ThoughtSpasm will treat as yours.

If you believe your account has been accessed by someone you didn't authorise, contact us right away and revoke the pairing from your phone's linked devices screen.

Acceptable use

In short
Don't use ThoughtSpasm to break the law, harm anyone, or abuse the service infrastructure.

You agree not to use ThoughtSpasm to:

  • store, process, or transmit content that is illegal where you live or where we operate;
  • attempt to access another user's account or data, or to circumvent our authentication, rate limits, or storage quotas;
  • reverse-engineer our service for the purpose of building a competing product;
  • send content that would oblige us to act as a publisher, broadcaster, or telecommunications provider under any law that applies to either of us.

Your content

In short
What you send stays yours. You give us the narrow licence we need to process it on your behalf — nothing more.

You retain all rights to the messages you send and the items derived from them. You grant us a limited, worldwide, royalty-free licence to host, copy, transmit, display, and process that content solely as required to provide ThoughtSpasm to you.

This licence ends when you delete the content or close your account, subject to the retention windows described in our privacy policy. We do not acquire any other rights to your content.

Billing

In short
ThoughtSpasm is free to use, with an optional Pro subscription that unlocks WhatsApp capture. Subscriptions are billed through the App Store or Google Play.

The core app is free to use. ThoughtSpasm Pro is an optional, auto-renewing subscription that unlocks WhatsApp capture and is billed through your Apple App Store or Google Play account. The price and billing period are shown in the app before you subscribe.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time from your App Store or Google Play account settings. We will give written notice in the app at least 30 days before any change to pricing.

Availability

In short
We aim for high availability but the service may go down for maintenance or for reasons outside our control.

We work to keep ThoughtSpasm available continuously, but we do not guarantee uninterrupted operation. Planned maintenance will be announced in-app when possible. Messaging-bridge connectivity, push delivery, and language-model availability depend on third parties and may degrade for reasons outside our control.

Termination

In short
Either of us can end the relationship at any time. You can delete your account by emailing us; we'll give you notice if we need to suspend yours.

You may stop using ThoughtSpasm at any time. To delete your account, email us at hello@echoeyecodes.com and we will hard-delete your data within 30 days, as described in our privacy policy.

We may suspend or terminate your account if you breach these terms, if your use threatens the security or integrity of the service, or if we're compelled to do so by law. Where reasonably possible, we will give you notice and an opportunity to fix the issue first.

Warranties and liability

In short
ThoughtSpasm is provided as-is. Our liability is capped at the amount you paid us in the previous twelve months.

To the maximum extent permitted by law, ThoughtSpasm is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, our aggregate liability to you for any claim arising from your use of ThoughtSpasm is capped at the greater of (a) the amount you have paid us in the twelve months preceding the claim and (b) US$50.

Nothing in these terms limits liability that cannot be lawfully limited — including liability for death, personal injury, or deliberate misconduct.

Governing law

In short
These terms are governed by the laws of England and Wales. Disputes go to the courts there, unless local consumer law gives you stronger protections.

These terms are governed by the laws of England and Wales. You and we both agree that any dispute arising from these terms will be dealt with by the courts of England and Wales, except that if you are a consumer and the law of your country of residence gives you protections that cannot be excluded by contract, you retain the benefit of those protections.

Changes

In short
We'll give 30 days' notice before any material change. Continuing to use the service after a change counts as acceptance.

We may update these terms as the product evolves. Material changes will be announced in the app at least 30 days before they take effect. Continuing to use ThoughtSpasm after the change date counts as acceptance; if you'd rather not accept, you can ask us to delete your account at hello@echoeyecodes.com before the change takes effect with no penalty.
